Terms of Service

These Terms of Service ("Terms") govern your use of the FormSentry application ("Service") provided by FormSentry ("we", "us", or "our"). By installing or using FormSentry, you agree to be bound by these Terms.

1. Service Description

FormSentry is a Shopify application that provides automated spam detection for storefront contact forms. The Service uses multiple detection methods, including behavioral analysis, content analysis, reputation scoring, and AI classification, to identify and block spam submissions.

2. Eligibility

You must have an active Shopify store to use FormSentry. By installing the app, you represent that you have the authority to bind the store owner to these Terms.

3. Account and Access

FormSentry is accessed through your Shopify admin panel. You are responsible for maintaining the security of your Shopify account. We are not liable for any unauthorized access resulting from compromised Shopify credentials.

4. Plans and Billing

FormSentry offers multiple subscription tiers with different usage limits. All billing is handled through Shopify's billing system and charged to your Shopify account.

  • Starter plan ($3.99/mo): 35 submissions per month, 3-day history.
  • Pro plan ($5.99/mo): 3,000 submissions per month, 30-day history, sensitivity controls, block/allow lists.
  • Business plan ($14.99/mo): 10,000 submissions per month, 90-day history, full feature access.

Subscription charges are recurring and billed monthly through Shopify. You may upgrade, downgrade, or cancel at any time. Cancellation takes effect at the end of your current billing cycle.

5. Usage Limits

Each plan includes a monthly submission limit. When you reach your limit, new form submissions will still be delivered to you but will not be checked for spam until the next billing cycle begins. We may notify you when you are approaching your limit.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent or manipulate usage limits, billing, or security measures
  • Use the Service to collect personal data for purposes other than legitimate spam protection
  • Resell, sublicense, or redistribute access to the Service

7. Spam Detection Accuracy

While we strive for high accuracy, no spam detection system is perfect. FormSentry may occasionally block legitimate messages (false positives) or allow spam through (false negatives). We provide tools to review blocked submissions and adjust sensitivity settings. You acknowledge that the Service is provided on a best-effort basis and we are not liable for missed spam or incorrectly blocked messages.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT IT WILL DETECT ALL SPAM OR NEVER BLOCK LEGITIMATE MESSAGES.

9. Data Ownership

You retain ownership of all data submitted through your store's forms. We do not claim any intellectual property rights over your content. We process your data solely to provide the Service as described in our Privacy Policy.

10. Intellectual Property

The Service, including its design, code, algorithms, and documentation, is owned by FormSentry and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

12. Limitation of Liability

To the maximum extent permitted by law, FormSentry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold FormSentry harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Dispute Resolution

Any dispute arising from these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through the courts specified in the Governing Law section below.

You agree that any claims shall be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against FormSentry.

15. Termination

You may terminate your use of FormSentry at any time by uninstalling the app from your Shopify store. We may suspend or terminate your access if you violate these Terms or if your Shopify store is deactivated. Upon termination, your data will be deleted in accordance with our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app dashboard. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Germany. Mandatory consumer protection laws of your country of residence shall remain unaffected.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
